TERMS AND CONDITIONS SERVICES

1. About your Agreement

1.1 This agreement contains the terms and conditions under which we supply the services to you and make product instalment plans available to you.

1.2 These Terms along with any other terms that you agree to are binding on you and us.

1.3 When we say 'we', 'us' or 'our', we mean GPS Secure. Details of our current registered office address can be found on our website, gps-secure.co.

1.4 Your agreement is personal to you. You remain responsible for complying with your agreement. You may only assign your agreement to another person with our prior approval.

2. Term of your Agreement

2.1 Your agreement with us commences when we commence the services.

2.2 You agree that the term of this Agreement is the period specified in the Monitoring Term.

3. What we will provide to you

3.1 Once you are Commissioned, we will provide you with access to the Services throughout the Term from the date of this Agreement.

3.2 We will always try to make the Services available to you. However, there are inherent limitations involved in the supply of GPS Services. Services are only available within GSM/WCDMA/LTE Network coverage area (NCA). Within the QNCA there may be places where access to Services is limited or unavailable.

3.3 There may be situations where services are not continuously available or the quality is affected:

3.3.1 when we need to perform any upgrading, maintenance or other work on the GPS Secure network or Services;

3.3.2 because of factors outside our control, such as the weather or interference caused by physical obstructions;

3.3.3 Limitations due to technology and/or services provided by 3rd party suppliers.

3.4 Your positional data is protected by our privacy terms and conditions, and will not ever be provided to any other party. Where preset service intervals are set, your dealer will be notified of approaching service intervals only.

4. Payment Terms

4.1 All goods purchased have a 3 year replacement warranty.

4.2 All goods purchased include device and 12 months of service included.

4.3 All goods purchased remain the property of GPS Secure until paid for in full.

4.4 All invoices are due 30 days from date of invoice.

5. Data Protection and Privacy

5.1 We are committed to protecting your privacy and handling your data in accordance with applicable data protection laws.

5.2 Your personal information will only be used for the purposes of providing our services and will not be shared with third parties without your consent.

6. Limitation of Liability

6.1 We will not be liable for any indirect, consequential, or incidental damages arising from the use of our services.

6.2 Our maximum liability under this agreement shall not exceed the total amount paid by you for the services in the 12 months preceding the claim.

7. Termination

7.1 Either party may terminate this agreement by providing 30 days written notice.

7.2 Upon termination, you must return any equipment provided and settle all outstanding payments.

8. Changes to Terms

8.1 We reserve the right to modify these terms and conditions at any time. Changes will be communicated to you via email or through our website.

8.2 Continued use of our services after changes have been made constitutes acceptance of the new terms.
